THIS GIVEAWAY ONLY OPEN TO PERSONS WHO ARE SPOTIFY® PREMIUM AND/OR APPLE MUSIC(R) MEMBERS AS OF THE BEGINNING OF THE GIVEAWAY PERIOD.

HOW TO ENTER:
The Geojam: Experience Music Together Campaign (the “Giveaway”) will begin on February 28, 2021, at 11:59 PM PT (the “Giveaway Period”).
To enter, download the iOS version of the Geojam application (“App”), log-in or create an account using your Spotify® Premium or Apple Music® account, and then join the “Experience Music Together” event (“Event”) on the App. Note that the official holder of the Spotify Premium or Apple Music account will be considered the official App user and Giveaway entrant.
Once, you have joined the Event on the App, you qualify for the Giveaway by (i) Posting a video with you and your friends using Geojam on your social media accounts, and (ii) tagging @geojammusic and #ExperienceMusicTogether in your posts.
To download the App, participants must have a smart phone or other web-enabled device operating iOS version 11 or later. Participants may incur message or data charges from their wireless service provider d. Check with your wireless service provider for details on these and other applicable charges. Participants are solely responsible for any such wireless charges. No other forms of entry are valid.
At the conclusion of the Giveaway Period, all entries will be reviewed by the Company and two winners will be included in a media campaign around Experience Moments Together. The Giveaway winners will be announced June 30, 2021 at or around 3pm.
This Giveaway is not sponsored, endorsed or administered by Spotify® or Apple Music® , nor is Spotify® or Apple Music® associated with this Giveaway in any way. By entering this Giveaway, you understand that you are providing information to the Sponsor and not to Spotify® or Apple Music®. By entering this Giveaway, you completely release Spotify® and Apple Music®from any and all liability for losses or injuries caused or claimed to be caused by participating in the Giveaway. Any questions, comments or complaints regarding this Giveaway must be directed to the Sponsor and not to Spotify® or Apple Music®.
All entries become the exclusive property of Sponsor and will not be acknowledged or returned. Sponsor reserves the right to void entries made or points generated through robotic, automatic, mechanical, programmed or similar duplication method and to disqualify any individual using such a method. Proof of submission of entry shall not be deemed proof of receipt by the Sponsor.
ELIGIBILITY RESTRICTIONS:
Giveaway is open to (i) legal residents of the United States and the District of Columbia, who are of legal age of majority in the jurisdiction in which they reside (and at least 21 years old) at the time of entry; and (ii) subscribers to either the Spotify® Premium or Apple Music® service as of the beginning of the Giveaway Period. Void outside United States and District of Columbia and where prohibited or restricted by law, rule or regulation. Employees of Geojam, Inc. (“Sponsor”), Spotify®, Apple Music®, or their parent, subsidiary, and affiliated entities, advertising and promotion agencies (collectively, “Released Parties") and members of their immediate families (spouse, parent, child, sibling and their respective spouses) and/or households are ineligible to participate or win. Proof of residency and age may be required. Giveaway is subject to applicable federal, state and local laws and regulations and is void where prohibited by law.
PRIZES:
Two (2) Prizes: There will be two (2) prize winners of the Giveaway. The winners will receive an opportunity to be included in a Geojam TV Commercial & National Media Campaign. This prize has no monetary value. Unclaimed prizes will not be awarded. Each winner is fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). Except where otherwise expressly noted in these Official Rules, the selection of all vendors, prizes, products and services is subject to the Sponsor’s sole and absolute discretion. Prizes (and/or any portion thereof) are nontransferable and non-exchangeable. No substitutions or cash redemption of Prize is permitted except that Sponsor retains the right to substitute a prize of equal or greater retail value (or at Sponsor's election, the cash value of the Prize). Additional restrictions may apply.
WINNER SELECTION AND NOTIFICATION:
At the conclusion of the Giveaway Period, the Company will review all entries and will select two (2) Giveaway entrants. The winners are subject to verification by Sponsor in its sole discretion. Sponsor’s computer is the official time keeping device for the Giveaway. Decisions of Sponsor with respect to the Giveaway are final. Odds of winning depend upon the number of Giveaway participants engaging in the campaign. If a potential winner cannot be contacted, or if a Prize notification is returned as undeliverable, potential winner forfeits prize. Sponsor is not responsible for any change in Spotify® or Apple Music® account information of entrants. Please see Sponsor’s privacy policy for details of Sponsor’s policy regarding the use of personal information collected in connection with this Giveaway. If you are verified as the prize winner, your first name, last initial, city and state will be included in a publicly-available winner’s list.
If Sponsor so elects, potential winners may be required to submit to a confidential background check. Such background check may include (but is not limited to) investigation of criminal, sexual offenses, or other arrest or conviction record, and any other factor deemed relevant by the Sponsor to help ensure that the potential winner will not bring the Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Sponsor. If requested, the potential winner agrees to sign waiver forms authorizing the release of personal and background information. In the event of noncompliance, to be determined at the sole discretion of Sponsor, prize will be forfeited and will be awarded to an alternate winner.
CONDITIONS: By participating, participants agree to abide by these Official Rules. By participating in the Giveaway, the winner or winners agree to have their name, Spotify® handle or Apple Music® handle, voice, likeness or biographical information used or published in any media relating to this Giveaway without additional financial or other compensation. The winners agree to sign a publicity release confirming such consent prior to acceptance of the prize. The Released Parties are not responsible for: (i) Giveaway entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected or not received by the Sponsor or its agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrant’s or any person’s computer or cell phone and/or its contents, or causes beyond Released Parties’ reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Giveaway: (iv) any entries submitted in a manner that is not expressly allowed under these Official Rules (all such entries disqualified); (v) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in the Giveaway, or (vi) any typographical or other errors in the printing, the offering or the administration of the Giveaway, or in the announcement of a Prize.
INTELLECTUAL PROPERTY: As a condition of participating, participants agree (and agree to confirm in writing), to authorize Sponsor the right and permission to copyright and/or publish, reproduce or otherwise use participants name, voice, and likeness in video, photographs, written materials, and audio-visual recordings. Participants acknowledge and understand these materials about or of participant may be used for both commercial and/or non-commercial purposes.
Participants understand that images may be edited, copied, exhibited, published and/or distributed. Participants also understand this material may be used individually or in conjunction with other media in any medium, including without limitation to print publications, digital publications, and/or public broadcast for any lawful purpose. There is no time limit on the validity of this release nor are there any geographic limitations on where these materials may be distributed. Participants hereby acknowledge and grant Geojam Inc. and its employees, agents, licenses, successors, and third-party organizations all ownership rights and irrevocable right and permission to use, copyright, publish, sell, distribute, and/or promote the recorded video, photo, interview, and/or audio. Participants understand that participation is voluntary and that they may, at any time, discontinue their involvement before signing this document. If Participants choose to discontinue participation, they will notify the principal parties Geojam Inc. by providing written notice by June 1, 2021. Participants understand that Geojam Inc. can see no risk presently, and that I take full responsibility for my involvement in this project and the risks that it may entail (be they legal, physical, or mental) and release Geojam Inc. from any claims, demands, losses, damages, suits, and liabilities of any kind whatsoever in connection with the foregoing.
If for any reason this Giveaway cannot be executed as planned, including but not limited to infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Released Parties that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Giveaway, or if the Giveaway is compromised or becomes technically corrupted in any way, electronically or otherwise, the Released Parties reserve the right to cancel, terminate or modify the Giveaway. Sponsor reserves the right, at its sole discretion, to disqualify and prosecute any individual who tampers with or attempts to tamper with the entry process or who enters or attempts to generate points using any automatic or programmed duplication method that is prohibited under these Official Rules.
CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR OTHERWISE CORRUPT OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Failure to comply with these Official Rules may result in an entrant’s disqualification solely at the discretion of the Sponsor. For the names of the prize winner, send a self-addressed stamped envelope for receipt by December 31, 2021, to GeoJam, Inc., 512 Rose Ave #225, Venice, CA, 90291, Attention: Marketing and Promotions Department.
DISPUTES AND GOVERNING LAW: As a condition of participating, participants agree (and agree to confirm in writing): (a) to release Released Parties from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any Prize, (b) that under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Giveaway, or any Prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court. By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules.
Participants in the Giveaway hereby consent to the exclusive jurisdiction and venue of California courts (state and federal) in Los Angeles County for any causes or controversies arising out of the Giveaway. Participants waive any and all objections to jurisdiction and venue in these courts. Participants hereby agree that any and all disputes, claims, causes of action, or controversies (“Claims”) arising out of or in connection with this Giveaway shall be resolved, upon the election by participant or Sponsor, by arbitration pursuant to this provision and the code of procedures of either the National Arbitration Forum (“NAF”) or the American Arbitration Association (“AAA”), as selected by the entrant. IF ARBITRATION IS CHOSEN BY ANY PARTY WITH RESPECT TO A CLAIM, NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE THAT CLAIM IN COURT OR HAVE A JURY TRIAL ON THAT CLAIM. EXCEPT AS SET FORTH BELOW, THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING. NOTE THAT OTHER RIGHTS THAT PARTICIPANT WOULD HAVE IF PARTICIPANT WENT TO COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. The arbitrator’s authority to resolve Claims is limited to Claims between Sponsor and participant alone, and the arbitrator’s authority to make awards is limited to awards to Sponsor and participant alone. Furthermore, Claims brought by either party against the other may not be joined or consolidated in arbitration with Claims brought by or against any third party, unless agreed to in writing by all parties. No arbitration award or decision will have any preclusive effect as to issues or Claims in any dispute with anyone who is not a named party to the arbitration.
